One of AmCham’s noteworthy legislative engagements in 2024 focused on the Draft Law on Personal Data Protection. The Chamber played an active role throughout the consultation and drafting processes, ensuring that the interests and concerns of its members were thoroughly represented.

AmCham organized consultative and informational roundtables with the Commissioner for the Right to Information and Protection of Personal Data, creating a platform for constructive dialogue. Additionally, AmCham actively submitted member comments and participated in the review process within parliamentary committees, contributing to critical improvements in the legislation.

Main Discussion Points:

  • Several proposed amendments were approved, mostly focused on linguistic and legislative technicalities, without affecting the full alignment with GDPR.
  • One of the key changes is the addition of paragraph 4 to Article 94, which outlines:
  • The obligation for the Commissioner for the Right to Information and Protection of Personal Data to issue a specific guideline for the methodology of imposing sanctions for identified violations.
  • This methodology must fully comply with the standards set by the European Data Protection Board to ensure proportionality in the administrative measures that can be applied for violations.

Impact on Businesses:

This amendment addresses one of the main concerns of businesses, regarding the proportionality of administrative sanctions. However, it remains to be seen how this provision will be enforced in practice.
