The Legal, Regulatory, and IPR Committee and the Digital Business Committee at AmCham organized an informative meeting with the presence of Besa Velaj, Director of the Office of the Commissioner for the Right to Information and Data Protection. The presentation of a new draft law on data protection, which incorporates changes aligned with European legislation and considers the technological and digital developments in business operations, was well-received by the members. They had numerous inquiries regarding the practical implementation of the law and the resulting obligations. Emphasizing the significance of informative meetings, the Executive Director of AmCham highlighted the organization’s efforts, through the Investment Agenda, to create a sustainable environment for businesses and investors, including the establishment of secure data processing practices in compliance with legal requirements.
Prior to the event, the American Chamber of Commerce conducted a survey among its members to gauge their level of awareness and the specific issues they wished to address with the Office of the Commissioner for Information and Data Protection. Albana Karapanco, Chair of the Legal, Regulatory, and IPR Committee, shared the survey results, revealing that over 50% of the respondents indicated their awareness of the legal changes but expressed a lack of information regarding the practical implementation of the legal provisions. They expressed a need for further information and training in this area.
Many of the questions raised by the members in the survey were addressed during the presentation by Besa Velaj. She focused not only on the ongoing legal changes but also on the current status of the law, which is undergoing consultation with the structures of the European Union. Ms. Velaj explained that the legislation takes into account rapid technological and digital developments, aligning it with European standards. Some of the significant changes highlighted by Ms. Velaj include the expansion of data protection areas, a new approach to the duties and advisory roles of data controllers, and the extension of data subjects’ rights.
Edrin Fidhe, General Manager of DPO Albania sh.p.k., provided insights into the implementation of the law and its level of familiarity among businesses. During his presentation, Mr. Fidhe mentioned the key challenges faced in implementing the law, ranging from inadequate understanding of the legal requirements to non-compliance with fundamental principles and technical criteria related to data processing.
Linda Shomo, Chair of the Digital Business Committee, expressed her opinion during the discussion with the members that technological advancements and digital developments will inevitably result in legal changes that businesses need to be aware of. To facilitate this, the American Chamber of Commerce, through its committees, should remain updated and organize informative and training sessions to present these legal changes to its members.

Prezantimi i projektligjit të ri për mbrojtjen e të dhënave personale i cili ka ndryshime që e përafrojnë me legjislacionin europian duke marrë në konsideratë dhe zhvillimet teknologjike dhe digjiale në të cilat operon biznesi, u mirëprit nga anëtarët të cilët kishin mjaft pyetje në lidhje me zbatimin në praktikë të ligjit dhe detyrimet që rrjedhin prej tij. Drejtori Ekzekutiv i AmCham theksoi rëndësinë e takimeve informuese dhe punën që po bën AmCham përmes Axhendës së Investimeve për të krijuar një ambjent të qëndrueshëm për biznesin dhe investitorët, pjesë e së cilit është dhe puna për të krijuar një ambjent të sigurtë në procesimin e të dhënave përmes njohjes ligjore.
Dhoma Amerikane i parapriu eventit duke organizuar një pyetësor me anëtarët për të kuptuar nivelin e informimit të tyre dhe cështjet që donin të trajtonin me Zyrën e Komisionerit për Informim dhe të Dhënat Personale. Albana Karapanco, Kryetare e Komitetit Ligjor, Rregullator dhe IPR, duke folur mbi rezultatet e pyetësorit informoi se mbi 50 për qind e anëtarëve ju përgjigjën pyetësorit duke treguar se kishin informacion mbi ndryshimet ligjore por nuk ishin të informuar për zbatimin teknik në praktikë të dispozitave ligjore dhe kishin nevojën e informimit dhe trajnimeve në këtë fushë.
Shumë nga pyetjet e ngritura nga anëtarët në pyetësor, morën përgjigje nga prezantimi i Besa Velaj, e cila u përqëndrua jo vetëm në ndryshimet ligjore që po pësonte ligji por edhe statusin e momentit i cili është në konsultim e sipër me strukturat e BE – së. Znj. Velaj ka shpjeguar se legjislacioni ka marrë në konsideratë zhvillimet e vrullshme teknologjike dhe dixhitale duke u përafruar me legjislacionin europian. Në ndryshimet më të rëndësishme të përmendura nga zjn.Vela ishin zgjerimi i fushave të mbrojtjes së të dhënave, një qasje e re mbi detyrat dhe tagrin këshillimorë të kontrollueseve si dhe zgjerim i të drejtave të subjektit.
Një këndvështrim mbi zbatimin e ligjit dhe nivelin e njohjes së tij nga biznesi, ka bërë Edrin Fidhe, Drejtor i Përgjithshëm i DPO Albania sh.p.k. Në prezantimin e tij z. Fidhe përmendi problematikat më të mprehta të zbatimit të ligjit, nga njohuria e dobët mbi ligjin deri në mosrespektimin e parimeve themelore dhe kritereve teknike ligjore në përpunimin e të dhënave.
